Privacy policy
Protecting your personal data is important to us. In this privacy policy we inform you in accordance with Art. 13 and 14 of the General Data Protection Regulation (GDPR) about which personal data we process when you visit our website, for which purposes and on which legal basis, and what rights you have. The German version of this privacy policy is legally binding.
1. Controller
Kuxmann Landmaschinen GmbH
Am Sportplatz 30
33619 Bielefeld
Germany
Phone: +49 (0)521 31433
Email: info@kuxmann.de
For all questions about data protection and to exercise your rights, please contact us at datenschutz@kuxmann.de or at the postal address above, marked “Datenschutz”.
2. Hosting and server log files
Our website is operated by [HOSTING PROVIDER, ADDRESS]. We have concluded a data processing agreement with the provider in accordance with Art. 28 GDPR.
Each time you access our website, the web server automatically processes information transmitted by your browser:
- IP address of the requesting device
- date and time of access
- requested page or file and amount of data transferred
- HTTP status code
- referrer URL (the previously visited page)
- browser type and version, operating system
This data is technically required to display the website and to ensure its stability and security (e.g. to fend off attacks). The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the secure and functional operation of the website. Log files are deleted after [NUMBER] days unless they are needed longer to investigate a specific security incident.
3. SSL/TLS encryption
For security reasons this website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in your browser’s address bar. Data you send to us, for example via our forms, cannot be read by third parties.
4. Cookies
We do not use cookies or any analytics or tracking tools for visitors to our website. A technically necessary session cookie is only set when editors log in to the administration area of the website (Section 25(2) no. 2 TDDDG, Art. 6(1)(f) GDPR); it is deleted when they log out or close the browser.
5. Contact form and offer requests
When you send us a message via the contact form or the “Request an offer” form on our product pages, we process the data you enter:
- Contact form: name, email address, subject and message
- Request an offer: email address, optionally phone number and special requirements, and the machine on whose page you submitted the form
Required fields are marked as such; without this information we cannot process your request. We use the data solely to answer your request or to prepare an offer for you. The legal basis is Art. 6(1)(b) GDPR insofar as your request is aimed at concluding a contract, and otherwise your consent pursuant to Art. 6(1)(a) GDPR, which you give by ticking the checkbox. You can withdraw your consent at any time with effect for the future, e.g. by email to datenschutz@kuxmann.de.
Your details are stored in our website database and forwarded by email to our sales team. For the contact form you also receive a confirmation at the email address you provided. Your IP address is not stored. Requests stored on the website are automatically deleted after 180 days. If your request leads to a contract or business correspondence, we keep the necessary documents for the statutory retention periods (Section 257 HGB, Section 147 AO; up to ten years).
To protect against automatically sent spam, our forms contain a field that is invisible to humans (“honeypot”). If it is filled in, the message is discarded; the IP address of the sending device is then stored briefly and deleted automatically after a few hours. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in preventing spam.
6. Contact by email or phone
If you contact us by email or phone, we process your details (e.g. name, contact details, content of the request) to handle your enquiry. The legal basis is Art. 6(1)(b) GDPR insofar as your enquiry relates to a contract or its initiation, and otherwise Art. 6(1)(f) GDPR (legitimate interest in answering enquiries). The data is deleted once your enquiry has been fully dealt with, unless statutory retention obligations apply.
7. YouTube videos
On some product pages we embed videos from the YouTube platform. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). The videos are only loaded when you click “Load video” (two-click solution). Before that, no data is transferred to YouTube. We use the privacy-enhanced mode (youtube-nocookie.com).
When you click, your browser connects to YouTube’s servers. Among other things, your IP address and the information which of our pages you visited are transmitted to Google. When a video is played, cookies or similar technologies may be stored on your device. If you are logged in to your Google account, Google can associate the visit with your account. A transfer of data to the USA cannot be ruled out; Google LLC is certified under the EU-US Data Privacy Framework, for which there is an adequacy decision of the European Commission (Art. 45 GDPR).
The legal basis is your consent given by clicking (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). It applies only to the respective video and the current page view. For more information, see Google’s privacy policy.
8. Recipients of your data
We only pass on your personal data insofar as this is necessary for the purposes stated, for example to our hosting provider as a processor or – as part of an order – to the sales and service partners involved. Your data is not passed on to other third parties or sold.
9. Your rights
You have the following rights with regard to your personal data:
- right of access (Art. 15 GDPR)
- right to rectification (Art. 16 GDPR)
- right to erasure (Art. 17 GDPR)
- right to restriction of processing (Art. 18 GDPR)
- right to data portability (Art. 20 GDPR)

Right to object (Art. 21 GDPR): Where we process your data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you may object to this processing at any time on grounds relating to your particular situation.
To exercise your rights, an informal message to datenschutz@kuxmann.de is sufficient.
10. Right to lodge a complaint with a supervisory authority
You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is:
Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen
Kavalleriestraße 2–4
40213 Düsseldorf, Germany

We do not use automated decision-making, including profiling (Art. 22 GDPR).
12. Changes to this privacy policy
